1. Acceptance of Terms

By accessing or using Hafizna ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

For minors (under 18): Your parent or legal representative must read and accept these Terms on your behalf and supervise your use of the Service.

2. Description of Service

Hafizna provides an online platform for Quran learning, connecting students with qualified teachers for one-on-one and group classes. Services include:

  • Live online Quran recitation and memorization classes
  • Arabic language instruction
  • Islamic studies courses
  • Progress tracking and learning resources
  • Teacher-student communication tools

3. Account Registration and Eligibility

3.1 Account Creation

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized account access

3.2 Minors (Under 18)

  • Students under 18 must provide a parent/legal representative's email and phone number
  • Account verification email will be sent to the parent/legal representative
  • Parents/legal representatives are responsible for supervising minor students' use of the Service
  • Parents/legal representatives receive all important notifications and policy updates

3.3 Teacher Accounts

  • Teachers must provide valid credentials and qualifications
  • Teacher accounts require an invitation code from administration
  • Teachers must provide accurate bank account information (IBAN) for payouts

4. Payment and Subscriptions

4.1 Pricing

  • Subscription fees are displayed on our pricing page and are subject to change with 30 days notice
  • All prices are in EUR unless otherwise stated
  • New subscribers receive a 7-day free trial; no charge if canceled before trial ends

4.2 Payment Processing

  • Payments are processed securely through Stripe
  • You authorize us to charge your payment method for subscription fees and session packs
  • Failed payments may result in service suspension

4.3 Refunds

  • Trial period: Cancel anytime during 7-day trial for no charge
  • Subscriptions: Pro-rated refunds available within first 14 days of billing cycle for unused portion
  • Session packs: Refundable for unused sessions within 30 days of purchase
  • Completed sessions: Non-refundable

4.4 Cancellation

  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of the current billing period
  • No partial refunds for mid-cycle cancellations (unless within 14-day window)

5. Code of Conduct

All users must comply with our Code of Conduct. Specifically:

  • Respectful and appropriate communication at all times
  • No harassment, discrimination, or abusive behavior
  • No recording of sessions without explicit consent from all participants
  • No sharing of login credentials
  • Academic integrity - no cheating or plagiarism
  • Teachers must maintain professional boundaries

Violations may result in account suspension or termination without refund.

6. Intellectual Property

6.1 Our Content

All course materials, platform design, logos, and content are owned by Hafizna or licensed to us. You may not:

  • Copy, distribute, or sell our materials
  • Reverse engineer or extract source code from the platform
  • Use our trademarks or branding without permission

6.2 User Content

You retain ownership of content you submit (e.g., messages, notes). By submitting content, you grant us a license to use, display, and process it as necessary to provide the Service.

7. Session Policies

7.1 Attendance

  • Students must arrive on time for scheduled sessions
  • Late arrivals (>10 minutes) may result in shortened session time
  • No-shows without 24-hour notice forfeit the session (no refund or credit)

7.2 Rescheduling and Cancellation

  • Students may reschedule or cancel sessions with 24-hour notice
  • Teachers may cancel sessions due to emergency; session will be rescheduled or refunded

7.3 Teacher Payouts

  • Teachers earn commission for completed sessions (minimum 40 minutes)
  • Payouts processed monthly to provided bank account
  • Teachers responsible for their own taxes and compliance

8. Service Availability and Modifications

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • We may modify or discontinue features with reasonable notice
  • Scheduled maintenance will be announced in advance when possible

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Hafizna is provided "AS IS" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the last 12 months
  • We are not responsible for teacher conduct or quality of instruction (though we screen teachers)
  • We are not liable for third-party service failures (Stripe, Vercel, Zoom, etc.)

10. Indemnification

You agree to indemnify and hold harmless Hafizna from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Content you submit to the platform

11. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy. Key points:

  • We comply with GDPR and COPPA
  • Minors' data is protected with parental oversight
  • You have rights to access, correct, and delete your data
  • We do not sell personal information

12. Termination

12.1 By You

  • You may delete your account at any time from account settings
  • Account deletion is permanent and cannot be reversed
  • Active subscriptions will be canceled upon account deletion

12.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms or our Code of Conduct
  • Engage in fraudulent activity
  • Fail to pay subscription fees
  • Pose a safety risk to others

Termination for cause is immediate and without refund.

13. Governing Law and Disputes

These Terms are governed by the laws of France. Any disputes will be resolved through:

  • First: Good-faith negotiation
  • Then: Mediation (if negotiation fails)
  • Last resort: Courts of Paris, France have exclusive jurisdiction

EU consumers retain rights under applicable consumer protection laws and may bring actions in their country of residence.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via:

  • Email to all users (and parents/legal representatives for minors)
  • In-app notification
  • Updated "Last updated" date on this page

Continued use after notification constitutes acceptance. If you disagree with changes, you must stop using the Service and may request account deletion and pro-rated refund (if within 30 days of change).

15. Miscellaneous

  • Severability: If any provision is unenforceable, the rest remains in effect
  • No waiver: Our failure to enforce a right does not waive that right
  • Assignment: You may not transfer your account; we may transfer our rights
  • Entire agreement: These Terms (with Privacy Policy and Code of Conduct) constitute the entire agreement
